This PRIVACY POLICY (the "PRIVACY POLICY") explains the information we collect, how we use and share it, how to manage your privacy controls, and your rights in connection with our website, StatClub.com, our web and mobile applications, and our related online service offerings (collectively, the "SERVICES"). For purposes of this PRIVACY POLICY "Personal Information" means any information relating to an identified or identifiable individual.
We update this PRIVACY POLICY from time to time so please review this PRIVACY POLICY regularly. If we materially alter the PRIVACY POLICY, we will notify you of such changes by posting a notice on our website, StatClub.com, and/or contacting you at the e-mail address provided to us. Terms not otherwise defined in this PRIVACY POLICY have the meaning given to them in our TERMS OF SERVICE.
Personal Information We Collect
We collect information about you, including information that directly or indirectly identifies you, if you or other StatClub users choose to share it with StatClub. The sources from which we collect this Personal Information fall into three categories: information you provide, information we collect automatically, and information we collect from other sources. StatClub also collects information about how you use the SERVICES. In addition, you may choose to share information about yourself, your friends, and your activities with StatClub. Specific categories of data collected and received are outlined here.
When you access and use the SERVICES, we collect your name, email address, mobile phone number, physical mailing and billing address. This information helps secure and provide your with access to our SERVICES. Profile, activity and use information is collected about you when you choose to allow access to or upload a picture or video, post, or activity (including camera and device information, photo settings, image information, date, time and geo-location information, software information, and other metadata), view others' activities, or otherwise use the SERVICES.
We collect and process location information when you sign up for and use the SERVICES. We do not track your device location while you are not using the SERVICES.
We gather information from photos, videos, comments, messages, and other content you provide access to or share on the SERVICES.
When you make a payment on StatClub, you will be asked to provide payment information such as your payment card or other payment details. We use Payment Card Industry (PCI) compliant third-party payment services who may store your credit card information in accordance with applicable standards.
We collect information from your browser, computer, or mobile device, which provides us with technical information when you access or use the SERVICES. This technical information includes device and network information, cookies, log files and analytical information. Learn more about how we use cookies in this PRIVACY POLICY. The SERVICES use log files. The information stored in those files include your Internet Protocol address, browser type and settings, the date and time of your request, and how you interacted with the SERVICES.
By submitting a telephone number to the SERVICES, you agree that we may contact you at the number you provide, potentially using automated technology (including texts/SMS messaging) or a pre-recorded message. Your consent is not an obligation to receive any of our products and/or services.
How We Use Personal Information
We use the Personal Information we collect and receive as described below.
To provide and facilitate your engagement with the SERVICES. For example, we use your Personal Information to record and share your activities, so that you can interact with other users, to allow you to explore new events to attend, to share insights with the StatClub community, and to contact you regarding the SERVICES. We may also use your Personal Information to integrate with third-party services at your request or based on service features, enabling functionality that relies on external platforms;
To communicate with you. For example, we use your Personal Information to respond to your inquiries, comments, feedback or questions, and send administrative information to you, for example, information regarding the SERVICES, and changes to our terms, conditions, and policies. We may also send you marketing and promotional communications, including information about products, services, and events that may be of interest to you, unless you opt out;
To improve our SERVICES. For example, we use the Personal Information we collect and receive, including feedback you provide, to conduct research, and to analyze, develop, troubleshoot, increase functionality, and otherwise improved the SERVICES;
To protect you and the SERVICES. For example, we use your Personal Information to prevent fraud, criminal activity, or misuse of our Service, and to ensure the security of our IT systems, architecture and networks. We may also use Personal Information to comply with legal obligations and legal process;
To customize your experience. For example, we may suggest events that may interest your, users that you may want to follow, or new features you may want to try; and
Other purposes if we obtain your consent.
How Personal Information is Shared
We may share Personal Information in accordance with your preferences, as needed to run our business, provide the SERVICES, and where required for legal purposes. In addition, we may share aggregated and/or anonymized information with our business partners and other third parties.
Service Providers. We may share Personal Information with third parties who provide services to us, such as supporting, improving promoting and securing SERVICES, and processing payments. We may also engage service providers to collect information about your use of the SERVICES over time on our behalf, to promote StatClub or display information that may be relevant to your interests on the SERVICES or other websites or services.
Sharing Information and Activities using your StatClub privacy controls. We share your information with other StatClub users and the public in accordance with your privacy controls.
Targeted Advertising. We may use the information we collect and receive about you to provide you with targeted advertising.
Third Party Services Connected via API or Other Integrations. We enable you to share your information and content with third party apps, plugins, or websites that integrate with the SERVICES, as well as third parties who work with us to offer an integrated feature, such as a sponsor.
Aggregated Information. We may deidentify and aggregate the Personal Information you and others make available in connection with the SERVICES and share it with third parties.
Publicly Available Information. When you join StatClub, your profile and your activities are set to be viewable by everyone by default.
Acquirers of our Business or Assets. If we become involved in a business combination, securities offering, bankruptcy, reorganization, dissolution or other similar transaction, we may share or transfer your information in connection with such transaction.
Legal Requirements. We may preserve and share your information with third parties, including law enforcement, public or governmental agencies, or private litigants, if we determine that such disclosure is compelled by or reasonably necessary to comply with the law, including to respond to court orders, warrants, subpoenas, or other legal or regulatory process, or otherwise permitted by law. We may also retain, preserve or disclose your Personal Information if we determine that it is reasonably necessary or appropriate to: (1) prevent any person from death or serious bodily injury; (2) to address issues of national security or other importance; (3) to prevent or detect violations of our terms of service or fraud or abuse of our SERVICES or our users; (4) or to protect our operations or our property or other legal rights.
Your Legal Rights and How to Exercise Your Legal Rights
Privacy laws provide certain rights to users in certain jurisdiction. Below are rights that may be available to you under applicable laws.
Access and Portability. You have the right to know, and request access to, the Personal Information we collect, use, share, or otherwise process about you. You can access much of your information by logging into your account. If you require additional access, please contact us.
Right to Rectify, Restrict, and Delete. You have the right to rectify, restrict, or delete Personal Information, including by requesting that we correct (rectify) where inaccurate, restrict, or delete your personal information on your behalf.
Right to Object. Where we process your information based on our legitimate interests, you can object to this processing under certain circumstances.
Right to Revoke Consent. To the extent we rely on your consent to engage in certain processing, you have the right to withdraw that consent at any time.
In addition to the rights described above, below we provide a general description of additional rights and disclosures about your Personal Information that may be available to you under U.S. State privacy laws.
Right to non-discrimination. You have the right not to receive discriminatory treatment for the exercise of your privacy rights. We will not discriminate against you for exercising any of your U.S. State privacy law rights.
Right to opt out of personal information sales or shares. Under certain privacy laws, some non-monetary sharing of personal information with third parties – for example to provide you with targeted advertising on other platforms – may be considered a "sale" or "share" of personal information. To the extent such laws may consider this a sale or share of personal information, we do not "sell" or "share" your personal information for analytics or to serve you with targeted advertising on other platforms unless you accept non-essential cookies using our cookie banner.
Categories of Information. The types of Personal Information we collect include identifiers (such as name, email, gender, age, and contact information), internet or other network activity (such as your interactions with the SERVICES), geolocation data, commercial information, financial information, electronic information (such as your photos and their associated metadata), and inferences drawn from other Personal Information.
In addition to the rights described above, below we provide additional disclosures for California residents.
Privacy rights requests for non-customers. California privacy rights apply to all individuals (not just registered users). All such individuals who are California residents can request additional information about our privacy practices with respect to their information, as well as make the access, deletion, correction and opt-out requests described above, by contacting us. Please provide sufficient information that we can identify you, and be aware that we may employ a more extensive authentication process to verify your identity before responding to your request.
Data Retention
We keep Personal Information for as long as you use the SERVICES or otherwise authorize under this PRIVACY POLICY, or as reasonably necessary or advisable to fulfill the purpose(s) for which it was collected, provide the SERVICES, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, protect against fraud, enforce our agreements, and comply with applicable laws.
Use of Cookies
Please note that third party vendors, including but not limited to Google, may show advertisements for us on the Internet. Third party vendors, including but not limited to Google, use cookies to serve advertisements based on your prior access and use of the SERVICES. To opt out of Google's use of cookies and web beacons, you can visit the Google advertising opt-out page available on Google's website
In addition, we partner with third party ad networks to display advertising on our SERVICES or to manage our advertising on other sites. These third parties use non-personally identifiable information (e.g., click stream information, browser type, time and date, subject of advertisements clicked or scrolled over, hardware or software information, cookie and session ID) and personally identifiable information (e.g. IP address) during your access and use of the SERVICES and other websites in order to provide advertisements about goods and services likely to be of greater interest to you. These parties typically use a cookie, third party web beacon, or other similar technologies to collect this information.
We also work with third parties that collect information across various channels. Such third parties use this information to recognize you across different channels and platforms, including but not limited to, computers, mobile devices, smart TVs, over time for advertising, analytics, attribution, and reporting purposes. Your data may be transferred outside the country from which it was originally collected.
We and our third-party service providers, including Google, Facebook, and Instagram, may use cookies, pixels or other tracking technologies to collect information about your browsing activities over time and across different websites following your access and use of the SERVICES, and use that information to send targeted advertisements. Some browsers have a 'do not track' feature that lets you tell websites that you do not want to have your online activities tracked. Currently, we do not respond to browser 'do not track' signals, but we do provide you the option to opt out of targeted advertising. Security
We take reasonable precautions to protect your data, including Personal Information. We maintain administrative, technical, and physical safeguards appropriate to the sensitivity of your information and designed to protect against unauthorized users, disclosures, or access to personal information. Nonetheless, the transmission of information via the Internet is not completely secure and therefore we cannot guarantee the security of data sent to us electronically, and transmission of such data, including Personal Information, is therefore entirely at your own risk.

Users Only of Legal Age of Majority
The SERVICES are designed and intended for those who have reached the age of majority (18 years of age). By accessing and using the SERVICES, you affirm that you are at least 18 years of age or older. We are not liable for any damages that may result from a user's misrepresentation of age. We do not knowingly collect, maintain, or use Personal Information from children under 18 years of age, and no parts of our SERVICES are directed to children.
No one under the age of 13 is authorized to submit or post any information, including Personal Information, through the SERVICES. Under no circumstances may anyone under age 13 access or use the SERVICES. If you learn that a child has provided us with Personal Information through the SERVICES in violation of this PRIVACY POLICY, please contact us at privacy@statclub.com.
